Welcome to The moralfibres.co.uk website (the “Website”) owned and made available by Wendy Graham, trading as Moral Fibres (referred to in these Terms and Conditions as “we” and “us”).

The Terms and Conditions form part of an agreement between you, the end-user, and ourselves and sets out the conditions under which you may access the information, products, services and advertisements (the “Material”) available through the Website. By accessing, viewing or using the Material on the Website you have indicated to us that you both understand and agree to be bound by these Terms and Conditions. Limitation of liability

Indemnity

You agree to defend, indemnify, and hold Moral Fibres harmless from and against all losses, costs, damages, liabilities, and expenses (including reasonable lawyers’ fees, court costs, and other litigation and arbitration expenses) related to or arising from: (a) negligent acts or omissions or intentional misconduct with respect to your use of the Website or your violation of these terms; or (b) claims for infringement of the proprietary rights of any third party resulting from your use of the Website in violation of these terms.

Intellectual Property

The design, images and content of the Website are, unless otherwise stated, our property or our licensors’ property, and is protected by copyright laws.

We provide Material on the Website solely for your personal use and the reproduction of the whole or any part of the Website, except for any temporary copies made necessarily in downloading the Website, for purposes other than private and personal use, is prohibited, as is distributing, displaying or copying the Website, unless it is for the personal use of a third party.

No part of the Website can be reproduced on, transmitted to or stored on any other web site or other form of electronic retrieval system, nor may any part of the Website be accessed in such manner as to make it appear part of any third party’s web site without our prior written consent. Any waiver of, or failure to delay to enforce, this provision by Moral Fibres in the event of any breach of it on one or more occasion shall not prevent it from subsequently enforcing it in respect of that or any condition breach.

You may only link to the Website, in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to the Website in any website that is not owned by you. The Website must not be framed on any other site. We reserve the right to withdraw linking permission without notice.

The Website in which you are linking must comply in all respects with our content standards set out in the below section for submissions. We cannot guarantee that you have any right to use third-party owned content which is available on the Website and you must obtain permission from the third-party owner before using or downloading such content. Content which is copyright protected may not be changed nor may any author attribution notice or copyright notice appearing on such content be altered without first obtaining the appropriate consents. Except for the limited permission set out above, nothing on the Website should be construed as granting any other right or license.  

Data Protection

As with the vast majority of websites, we automatically log certain information about every request made of us, including users’ internet provider address. This information is used for the purposes of system administration, maintenance, problem solving and the production of usage statistics. Subsets of this data may be passed to the administrators of other computer systems or computer security teams for purposes such as the investigation of access problems or as part of investigations of computer misuse. Otherwise the logged information is not passed to any third party except as stated elsewhere in these terms and conditions. We take our responsibility under and compliance with the UK GDPR and the Data Protection Act 2018 very seriously. Submissions

Ownership If you submit content to the us (including without limitation any text, photograph, graphics, video or audio), you grant us an irrevocable, transferable, worldwide licence to use, reproduce, modify, adapt, publish, create derivative works from, distribute and display in public that content in any form and media on or in connection with the Website, at no cost to us and for as long as we require and you warrant that you own or have rights to the intellectual property in such content and have the right to grant this licence. You waive any moral rights in your contribution. You will indemnify us and keep us indemnified from and against all costs, claims, damages and expenses made against or incurred by us as a result of a third party alleging that the use of such content by us infringes the intellectual property rights of a third party. We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to the Website constitutes a violation of their intellectual property rights, or of their right to privacy. 

Submissions When submitting content, you agree not to do any of the following:

  • use the system of uploading  or transmitting content (or any part thereof) in a way that may cause the system (or the servers or networks connected to the system) to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of the system is in any way impaired; or
  • where you are not the author of any material you are uploading or transmitting, delete any author attributions, legal notices or proprietary designations within the material.

Changes to the Website

We reserve the right to change any part of the Website or these terms and conditions at any time without notice. Any changes to these terms and conditions shall take effect from the next time you access the Website. Notwithstanding the above, we shall not be obliged to keep the Website up to date.

Location, Jurisdiction & Applicable Law

These terms and conditions, your use of the Website, and all matters connected with them (whether contractual or non-contractual), are governed by and shall be construed in accordance with the law of Scotland and shall be subject to the exclusive jurisdiction of the Scottish courts. If you access the Website from outside Scotland you are responsible for ensuring compliance with any local laws relating to access and use.
